These Terms of Service (“Terms”) govern your use of the Obrix Solutions website and our web design, development, and management services. By using our website or engaging our services, you agree to these Terms.

1. About Us

Obrix is a trading name of Castlegate Property Solutions Ltd (Company Number: 16122339), registered in England and Wales. Registered Office: 38 Hanover Crescent, Shotton Colliery, DH6 2NR. 2. Our Services

2.1 Website Design & Development

We design and build custom websites based on your requirements. The specific scope of work, deliverables, and timeline will be agreed in writing before any project begins.

2.2 Pricing Structure

All plans consist of a one-off setup fee (payable before work begins) plus a monthly subscription fee. Our plans are:

• Starter (£299 setup + £49/month): Professional website, hosting, support, and minor content edits
• Professional (£499 setup + £99/month): Everything in Starter plus priority support, performance monitoring, analytics, lead forms, and SEO optimisation
• Business (£799 setup + £149/month): Everything in Professional plus unlimited content edits, advanced integrations, booking systems, and conversion optimisation

2.3 What's Not Included

Unless specifically agreed in writing, the following are not included in our standard plans:

• Domain name registration fees (typically £10-15/year)
• Third-party software licences or subscriptions
• Professional photography or copywriting
• Complete website redesigns (quoted separately)
• E-commerce functionality beyond basic integrations

3. Payment Terms

1. The setup fee is payable in full before work begins. Monthly plans are billed in advance on the same date each month.
2. Payment is due within 7 days of the invoice date.
3. We accept payment by bank transfer and major card payments.
4. All prices are in GBP and exclusive of VAT (if applicable).
5. If payment is not received within 14 days of the due date, we reserve the right to suspend hosting and services until the outstanding balance is paid.

4. Project Process

1. Discovery: We discuss your requirements and provide a proposal.
2. Design: We create a design for your approval. You will have the opportunity to request revisions (up to 2 rounds of revisions are included unless otherwise agreed).
3. Development: Once the design is approved, we build the website.
4. Launch: After your final approval, we launch the website and begin your monthly plan.

5. Client Responsibilities

To ensure we can deliver your project effectively, you agree to:

• Provide all requested content (text, images, logos) in a timely manner
• Respond to requests for feedback or approval within 5 working days
• Ensure any content you provide does not infringe on third-party rights
• Pay invoices on time in accordance with the payment terms above

If we do not receive content or feedback within 30 days, we reserve the right to launch the website with placeholder content and begin the monthly plan.

6. Intellectual Property

• Your content: You retain ownership of all content you provide (text, images, logos, branding).
• Our work: Upon full payment, you are granted a licence to use the website design we create for you. The underlying code and design framework remain our intellectual property.
• Portfolio rights: We reserve the right to showcase the work we produce for you in our portfolio and marketing materials, unless you request otherwise in writing.

7. Hosting & Uptime

We provide reliable hosting as part of our monthly plans. While we aim for maximum uptime, we cannot guarantee 100% availability. We are not liable for any losses resulting from temporary downtime caused by maintenance, hosting provider issues, or events beyond our control.

8. Cancellation

• You may cancel your monthly plan at any time by giving us 30 days' written notice via email.
• There is a minimum term of 12 months from the date your website is launched. Early cancellation within the minimum term will require payment of the remaining months' fees.
• Upon cancellation, we will provide you with a copy of your website files and content. Hosting will be discontinued at the end of your final billing period.
• We reserve the right to cancel your plan with 30 days' notice if payment is not received or if you breach these Terms.

9. Limitation of Liability

• Our total liability for any claim arising from our services shall not exceed the total fees paid by you in the 3 months preceding the claim.
• We are not liable for any indirect, incidental, or consequential damages including loss of profit, data, or business opportunity.
• We are not responsible for any losses resulting from content you provide, third-party service failures, or events outside our reasonable control.

10. Website Content

You are responsible for ensuring that all content on your website complies with applicable UK laws, including but not limited to:

• Consumer protection regulations
• Advertising standards
• Data protection laws (UK GDPR)
• Copyright and intellectual property laws

11. Use of Our Website

When using the Obrix website, you agree not to:

• Use the website for any unlawful purpose or in breach of these Terms
• Submit false or misleading information through our contact form
• Attempt to gain unauthorised access to our systems or interfere with the website's operation

12. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated date. Continued use of our website or services after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
